Book And Page Number:

Many states use a statewide recording system in which all deeds and recordings of land between the person granting his or her land ("grantors") and the person to whom the land is granted ("grantees,") are recorded in one large indexing system. When a document is filed in this system, it will receive a book and a page number assignment, that shows the book and page number on which the document was filed. If you do not have the book and page number, or the serial number, then we will leave this space blank on your deed for you and you can fill it in later on your own.

Encumbrance:

An encumbrance is a claim or a liability upon property, such as a lien or a mortgage. It will not prevent transfer of the property, but it will remain upon the property after transfer is completed. Therefore if a lien exists on the property, it will still exist even though the property has been transferred to another. An encumbrance stays with the property rather than with the person whose name is on the title.

Consideration:

Consideration is something of value that is given in exchange for receiving something from another person. It can sometimes be an act, a forbearance to act, or for a promise in exchange for the one you have given, but historically it has been for money. On the quitclaim and warranty deeds, some states require the entry of a specific dollar amount, and you must choose the dollar amount to enter. It does not have to be for a large sum of money, but rather any amount, such as $5.00, is adequate consideration.

Legal Description Of The Property:

This means a formal, technical description of the property, i.e. one that allows a particular piece of land to be found and identified. It is generally not the address of the property. You can find the legal description for the property that you are deeding in the deed that you have conveying the property to you. You should use the description exactly as it it worded in the deed, so there will be no questions as to the property you are conveying.

Deeding The Property:

When you are deeding property , you are using a written document to convey property or interests from one individual or individuals to another. A warranty deed is a deed that transfers property ownership from the seller to the buyer and it guarantees that the seller has good and clear title to the property.

Marital Status:

We need to know whether a married couple will be deeding the property. For example, if a husband and wife want to give a piece of land to a certain other person, then a married couple would be deeding the property. If a husband wishes to give a piece of property to his wife (or vice versa), then a single individual will be deeding the property.
